Yes but your argument and that of many fails to concider that on the
high seas the captain is the law. Pirates have no rights except for
the right to a short drop and a sudden stop. That being if the weren't
shot first naturally. Still they fucked up and brought him to court so
he had to be tried...that's the law.

if convicted, sentence him and throw him in jail.

You probably want to accept surrenders under most
circumstances and make it more desirable than fighting
to the last bullet.

Like I said, the choice of getting shot or spending
the rest of their lives in jail, even a fairly posh jail
ought to be a deterrent. The big question is whether
they're going to get caught or not. If they do, neither
of the two alternatives looks very attractive.
