When the state court is absolutely sure that the property comes from
criminal sources. A state court can order a confiscation. Not otherwise.

Where? In Poland? No, they can't keep your car, even if they caught you
smuggling drugs. Court can order a confiscation, but it's not a simple
matter, by any means.

In Poland, I wouldn't know. In the USA, ALL states ( and
Federal ) have confiscation laws related to drug offenses. It's
complete bullshit, I agree, but it's also the law.
