If you make it into the intersection on yellow or even green, you never know if it'll ticket you if you can't get out of the intersection if it turns red first. People here are concerned and try to stop if there's any question. Rear-end accidents have increased as a result. The bigger concern is though, that our camera's also ticket for speeding and the burden of proof is on the driver to prove that you weren't. If you get a speeding ticket, I don't know how you could possibly prove to the court that you weren't speeding, particularly if you get the notice a month or two after the event. I've gone through intersections when no one was speeding (green light) and the flash has gone off. I now try my best to avoid intersections with cameras and usually have to go well out of my way to do it. Tevors

The car was in the shop at the time, so obviously I wasn't the driver. But the city ordinance makes me financially responsible as the owner, regardless. I'll probably get the $75 out of the repair shop, but even if I do I have to waste the time. And if they won't pay, I'm screwed. Now tell me this is about safety and not revenue. - B

It is not illegal in NM to be in the intersection when the signal goes from yellow to red, as long as you are clearing the intersection; why is the system set up to ticket those people? Do you have a cite for this practice? NMS 66-7-105 says steady yellow following green means "vehicular traffic facing the signal is warned that the red signal will be exhibited immediately thereafter and the vehicular traffic shall not enter the intersection when the red signal is exhibited..." |
